U Aristotelovoj politici počelo mjere prvenstveno je vezano za balansiranje političkih poredaka, ali postoji i druga perspektiva u kojoj je više riječ o vrlini i moralnim kvalitetama aristokracije, gdje se identificira dobrog čovjeka i građanina. Consensus conferences, also known as citizens’ panels—a collection of lay citizens akin to a jury but charged with deliberating on policy issues with a high technical content—are a potentially important way to conduct technology assessments, inform policy makers about public views of new technologies, and improve public understanding of and participation in technological decision making. The first citizens’ panel in the United States occurred in April 1997 on the issue of “Telecommunications and the Future of Democracy.” This article evaluates the (...) impact of this citizens’ panel. The standard criteria to evaluate the impact of analyses focus on the “actual impact” and on the “impact on general thinking.” To these standard criteria, this article introduces the evaluation of two impacts related to learning: impact on the training of knowledgeable personnel and the interaction with lay knowledge. The impact evaluation is based on a nearly comprehensive set of semistructured telephone interviews with the participants in the panel. (shrink)

The U.S. military has now occupied Iraq for more than five years. This is a long time for one state to impose a military occupation on another. But of course the American occupation of Iraq seems almost momentary by comparison with Israel’s fortyone-year occupation of Palestinian territories in the West Bank and Gaza. Considering how controversial both these occupations have been, one would expect them to have elicited a substantial body of thought about the moral dimensions of the practice of (...) occupation. But such an expectation would be disappointed. There is, of course, a body of law governing the practice of occupation, but the moral foundations of that law have suffered the same neglect by moral and political theorists that the practice of occupation itself has. As I prepared my remarks for the conference from which this symposium issue is derived, I was surprised to be unable to recall having read or even seen any philosophical discussions of occupation. I own most of the books that have been written on the theory of the just war over the past half century or so, but a search through their indexes turned up only a few entries on occupation, none of which proved, on investigation, to offer significant illumination. I have not, however, had to conjure up a theory de novo. Occupation involves both the threat of military force and, usually, the use of military force; hence it is akin to, and indeed often overlaps with, war (as the alternating references to the occupation of Iraq and the war in Iraq attest). We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. After (...) all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

one hand, it raises fundamental doubts about the Davidsonian project, which seems to involve isolating specifically semantic knowledge from any other knowledge or skill in a way reflected by the ideal of homophony. Indexicality forces a departure from this ideal, and so from the aspiration of deriving the truth conditions of an arbitrary utterance on the basis simply of axioms which could hope to represent purely semantic knowledge. In defence of Davidson, I argue that once his original idea for dealing (...) with the familiar indexical expressions is suitably implemented, in terms of theorems expressing conditional truth-conditions, the contrast between semantic and nonsemantic knowledge occurs in an appropriate place: between knowledge of the conditional truth conditions themselves (semantic), and knowledge of their antecedents (non-semantic). For example, a simplified version of a conditional truth condition for an utterance u of “That is a cat” will say that for all x, if the utterer in uttering “that” in u thereby referred to x, u is true iff x is a cat. The conditional fact belongs to semantic knowledge; non-semantic knowledge is required to work out what the utterer referred to; the two kinds of knowledge conspire to enable a truth condition to be detached. The other kind of worry relates to difficult technical questions, relating to specific idioms, raised by context-dependence. I consider whether an argument by Travis (2006), designed to establish that there can be no correct truth conditional semantics, can be turned on its head, and used to establish a general method for bringing all forms of context-dependence within Davidsonʼs framework (using quantification into the qualifier “on understanding U”). I argue that this will not work, and that we are committed to a piecemeal examination of various cases, of which I give some examples. One of these relates directly to Travisʼs argument concerning the context-dependence of “grunt”. In addition, Davidsonians need to have a sharp eye for the distinction between pragmatic and semantic content, to be specified by a test akin to Griceʼs notion of cancelability; they should treat sentences like “Itʼs raining” by the conditional truth-condition method; and they should treat possessives as semantically very unspecific. It is part of the thesis of the paper that this list of examples by no means exhausts the cases a Davidsonian needs to address. (shrink)

To what extent does the case for exemptions from laws to accommodate religious commitments rest specifically on egalitarian arguments? To what extent should specifically egalitarian or anti-discrimination concerns be used to determine when such exemptions should be granted? This Article considers both of these questions. It argues that while egalitarian considerations have a role to play in both the general justification and case-by-case evaluation of exemption claims, neither the justification, nor the evaluation of exemptions, properly rests solely on specifically egalitarian (...) considerations. At the level of justification, there is an important, independent role for something akin to the principle of respect for conscience recently put forward by Martha Nussbaum; and, when citizens come to evaluate particular claims for exemptions, the anti-discrimination approach put forward by Christopher Eisgruber and Lawrence Sager in the context of the U.S. and its constitutional tradition is more plausibly seen as a complement to the “balancing test” which has been used historically rather than as an alternative to it. Jeremy Waldron is well known for his disdain of U.S. jurisprudential doc- trine that allows courts to invalidate democratically enacted legislation on the ground it violates certain fundamental constitutional (and quasi-moral) rights. He believes that where disagreement on the relevant substantive is- sues is widespread among citizens and officials alike, it is illegitimate for judges to impose their views on the majority by invalidating a piece of enacted law. Even if we assume, plausibly enough, there are objective moral constraints on (...) what restrictions on behavior may be enacted into law, judges have no privileged access to the objective truth and must, like everyone else, rely on their own subjective intuitions and views. Given that judges are hence no more likely than citizens or legislators to reach the correct decision about what morality requires, these disagreements should be democratically resolved. As he puts it, if disagreement about rights is to be sorted out by counting heads, it should be the heads of citizens who have ultimate sovereignty in a democracy, rather than those of unelected judges, that ought to count.In this essay, I consider Wilfrid Waluchow’s response to Waldron’s argument in his outstanding new book, A Common Law Theory of Judicial Re- view, in which he attempts to provide the practice of judicial review with something akin to the foundation that justifies allowing judges authority over the development of the common law. I will begin with a short explication of Waldron’s argument and then consider Waluchow’s objections to Waldron, as well as Waluchow’s living-tree conception of a common-law constitution with content that evolves through a common law approach to reasoning in constitutional disputes.Resumen:A Jeremy Waldron se le conoce por el desprecio que ha manifestado con relación a la doctrina constitucional estadounidense que permite a los tribunales invalidar legislación que ha sido promulgada de manera democrática, dado que según Waldron lo anterior constituye una violación a ciertos derechos constitucionales (y cuasi-morales). Incluso si suponemos, de manera lo suficientemente plausible, que existen limitantes morales objetivas sobre las restricciones que el derecho puede contemplar en relación con el comportamiento de los ciudadanos, los jueces no gozan de un privilegio especial con el que puedan acceder a estas verdades objetivas y deben, como todos los demás, basarse en sus propios puntos de vista e intuiciones subjetivas. Traditional epistemic and doxastic logics cannot deal with inconsistent beliefs nor do they represent the evidence an agent possesses. So-called ‘evidence logics’ have been introduced to deal with both of those issues. The semantics of these logics are based on neighbourhood or hypergraph frames. The neighbourhoods of a world represent the basic evidence available to an agent. On one view, beliefs supported by evidence are propositions derived from all maximally consistent collections evidence. An alternative concept of beliefs takes them to (...) be propositions derivable from consistent partitions of one’s inconsistent evidence; this is known as Schotch-Jennings Forcing. This paper develops a modal logic based on the hypergraph semantics to represent Schotch-Jennings Forcing. Abstract:This essay explores performance-driven aspects of U.S. bands in the contexts of Pierre Hadot’s Philosophy as a Way of Life, Lewis Carroll’s Alice’s Adventures in Wonderland, Jacques Derrida’s Aporias, and the author’s experience teaching both elementary general music and beginning band. The author wonders what band education might look like when the profession’s fixation on futuristic performances and allegiances to past traditions are laid aside; the article proposes that the profession of band might benefit from a more present-focused, process-oriented approach (...) to making music, akin to that of the general music classroom setting. The author advocates for a deeper engagement in critical dialogue around the role tradition plays in current band education practices in ways that reach toward inclusive, present-focused music making. Pp. xiii, 197. isbn: 978-0230 -20116-3. £50; us$85. ver the past decade, Graham Stevens has built his reputation as a lucid, durable, and oftentimes ground-breaking historian of analytic philosophy. His latest book, entitled (...) TheTheory of Descriptions: Russell and the Philosophy of Language, will only add to that burgeoning scholarly legacy. If it has not been established already, this book will doubtless cement Stevens’ place amongst the leading Russell scholars in the world today. It may very well herald Stevens ’ arrival on the scene as a noteworthy contributor to contemporary philosophy of language as well. The central goal of the book is “to bring the historical and purely philosophical analyses of [Russell’s] work into closer alignment” (p. 3). Stevens hopes to overcome a “striking disparity” (p. 2) in the ways that Russell’s contributions to the philosophy of language have been conceived by expositors of his philosophy, on the one hand, versus philosophers of language, on the other. In particular, though contemporary philosophers of language would tend to view Russell’s enormous contribution to that subject as being “undeniable” (p. 1), and to be “bewildered” (p. 94) by any suggestion to the contrary, expositors of Russell’s philosophy have nevertheless been at pains to emphasize that Russell “was not engaged in the philosophical study of language” (p. 2). As Stevens notes, this situation is especially puzzling since “these two groups [of scholars] overlap to a considerable extent” (p. 2). Stevens’ strategy for overcoming this disparity is two-pronged. First he aims to tackle, head on, the fallacious arguments of Monk,1 Dummett,2 and others, to the effect that Russell was not engaged in the philosophy of language. According to Stevens, such arguments have principally appealed to either (1) ______ 1 Ray Monk, “What Is Analytical Philosophy?”. 2 Michael Dummett, Frege: Philosophy of Language. l= 86 Reviews Russell’s dismissal of ordinary language philosophy, (2) his early, non-linguistic, conception of the nature of propositions, or (3) his view that natural language was inherently defective for philosophical purposes, and so called for replacement by a “logically perfect language”. In regards to (1), Stevens argues in a word that “[o]rdinary language philosophy has had its day” (p. 176). Over the past several decades, in other words, leading philosophers of language have come to agree with Russell in viewing ordinary language philosophy as “an outdated, and rather eccentric, relic of mid-twentieth century British philosophy” (ibid.).The classic Russell– Strawson debate over the question whether ordinary language lacks an exact logic3 has been settled decisively in Russell’s favour, as philosophers of language have transformed “the attempt to systematically specify the semantics of large regions of natural language” (ibid.) into a “central project” (ibid.). In regards to (2), moreover, Stevens notes that by this line of reasoning, absurdly, David Kaplan would not qualify as a philosopher of language since he “explicitly invokes the Russellian non-linguistic conception of a proposition as the conception appropriate for providing the content of properly context-situated indexical sentences” (p. 170). And, of course, Kaplan is not at all unique amongst contemporary philosophers of language in appealing to a Russellian conception of propositional content, as the examples of Nathan Salmon,4 Scott Soames,5 and many others show. In regards to (3), finally, Stevens argues that Russell’s dim view of natural language was grounded in his conception of logical form as non-linguistic, and that that conception, in turn, derives simply from the poverty of syntactic theory available to Russell, prior to the Chomskyian revolution in linguistics during the second half of the twentieth century. This article argues that the causal loops that occur in some time-travel scenarios and in certain solutions of the theory of relativity are no more mysterious than the infinitely descending causal chains familiar from Newtonian mechanics.

It is argued by Lie et al in the current issue of the Journal of Medical Ethics that an international consensus opinion has formed on the issue of standards of care in clinical trials undertaken in developing countries. This opinion, so they argue, rejects the Declaration of Helsinki’s traditional view on this matter. They propose furthermore that the Declaration of Helsinki has lost its moral authority in the controversy in research ethics. Although the latter conclusion is supported by this author, (...) it will be demonstrated in this paper that there is not such a thing as an international consensus opinion, and that the authorities used by Lie et al as evidence in support of their claim should not be relied upon as authorities or final arbiters in this debate. Furthermore, it will be shown that arguments advanced substantively to show that lower standards of care are ethically acceptable in the developing world, conflate scientific with economic reasons, and ultimately fail to bolster the case they are designed to support. This paper offers a critique of the Bayesian interpretation of quantum mechanics with particular focus on a paper by Caves, Fuchs, and Schack containing a critique of the “objective preparations view” or OPV. It also aims to carry the discussion beyond the hardened positions of Bayesians and proponents of the OPV. Several claims made by Caves et al. are rebutted, including the claim that different pure states may legitimately be assigned to the same system at the same time, and the (...) claim that the quantum nature of a preparation device cannot legitimately be ignored. Both Bayesians and proponents of the OPV regard the time dependence of a quantum state as the continuous dependence on time of an evolving state of some kind. This leads to a false dilemma: quantum states are either objective states of nature or subjective states of belief. In reality they are neither. The present paper views the aforesaid dependence as a dependence on the time of the measurement to whose possible outcomes the quantum state serves to assign probabilities. This makes it possible to recognize the full implications of the only testable feature of the theory, viz., the probabilities it assigns to measurement outcomes. Most important among these are the objective fuzziness of all relative positions and momenta and the consequent incomplete spatiotemporal differentiation of the physical world. The latter makes it possible to draw a clear distinction between the macroscopic and the microscopic. This in turn makes it possible to understand the special status of measurements in all standard formulations of the theory. Whereas Bayesians have written contemptuously about the “folly” of conjoining “objective” to “probability,” there are various reasons why quantum-mechanical probabilities can be considered objective, not least the fact that they are needed to quantify an objective fuzziness. But this cannot be appreciated without giving thought to the makeup of the world, which Bayesians refuse to do. Doing this on the basis of how quantum mechanics assigns probabilities, one finds that what constitutes the macroworld is a single Ultimate Reality, about which we know nothing, except that it manifests the macroworld or manifests itself as the macroworld. The so-called microworld is neither a world nor a part of any world but instead is instrumental in the manifestation of the macroworld. Quantum mechanics affords us a glimpse “behind” the manifested world, at stages in the process of manifestation, but it does not allow us to describe what lies “behind” the manifested world except in terms of the finished product—the manifested world, for without the manifested world there is nothing in whose terms we could describe its manifestation. ObjectiveFreezing of gait is detrimental to patients with idiopathic Parkinson’s disease. Its pathophysiology represents a multilevel failure of motor processing in the cortical, subcortical, and brainstem circuits, ultimately resulting in ineffective motor output of the spinal pattern generator. Electrophysiological studies pointed to abnormalities of oscillatory activity in freezers that covered a broad frequency range including the theta, alpha, and beta bands. We explored muscular frequency domain activity with respect to freezing, and used deep brain stimulation to modulate these rhythms thereby (...) evaluating the supraspinal contributions to spinal motor neuron activity.MethodsWe analyzed 9 PD freezers and 16 healthy controls. We studied the patients after overnight withdrawal of dopaminergic medication with stimulation off, stimulation of the subthalamic nucleus or the substantia nigra pars reticulate, respectively. Patients performed a walking paradigm passing a narrow obstacle. We analyzed the frequency-domain spectra of the tibialis anterior and gastrocnemius muscles in ‘regular gait’ and during the ‘freezing’ episodes.ResultsIn stimulation off, PD freezers showed increased muscle activity of the alpha and low-beta band compared to HC in both TA and GA. This activity increase was present during straight walking and during the freezes to similar extent. STN- but not SNr-DBS decreased this activity and paralleled the clinical improvement of freezing.ConclusionWe found increased muscle activation of the alpha and lower beta band in PD freezers compared to HC, and this was attenuated with STN-DBS. Future studies may use combined recordings of local field potentials, electroencephalography, and electromyography to interrogate the supraspinal circuit mechanisms of the pathological activation pattern of the spinal pattern generator.
